WAIVER, RELEASE, ASSUMPTION of RISKS Prior to participating in Lake Joseph Yacht Club (LJYC) all participants in LJYC must accept return this waiver stating that they have read the conditions of the waiver and are aware of the risks associated with the event, and thus waive any right that they may have to any course of action against Lake Joseph Yacht Club., its directors and their respective agents, officials, volunteers and representatives for injury to the person(s) or loss/damage to personal property. 1. I and my next of kin and my parent(s) / guardian(s) are aware that there are risks associated with all water sports, including the sport of sailing. Certain of the risks and hazards include: launching, docking and storing equipment used in the sport of sailing, high winds that may cause rough water, natural forces which may result in obstacles and hazards, cold water in which extended immersion can be life-threatening, and weather that may change rapidly and be extreme, presenting significant challenges. I or the accepting parent/guardian hereby give notice that I am able to swim and that I voluntarily assume all risk of loss, damage or injury, including death, that may be sustained by me or to any property while engaged in said activities. 2. Therefore, to induce LJYC to accept his/her child into the Sailing Program, the accepting parent/guardian agrees to hold harmless and indemnify Lake Joseph Yacht Club, its officers, directors, employees and agents from any and all claims, losses, damages, fees and liability growing out of or in any manner related to injury to a person or damage to any property arising out of or in anywise connected with the operation of the LJYC or any activities on or the use of any facilities or equipment of Lake Joseph Yacht Club. SAFETY 3. I agree that I or my child will properly wear an approved personal flotation device at all times while participating in or near the water, and that I/we will follow the safety precautions and instructions prescribed by LJYC instructors or designated personnel. PHOTOGRAPHIC RELEASE 4. I hereby acknowledge that I or my child may be photographed while participating in LJYC activities and/or programs. I hereby unconditionally authorize LJYC, at its sole discretion, to use any such photographs in brochures, flyers, web site, and any other promotional or educational materials. PARENTAL AGREEMENT 5. I/we as parent/guardian understand that I/we are responsible for our child & guests behaviour and conduct while at LJYC and will see to it that our child adheres to the program rules. I/we agree to assume the obligation for expenses of repair and/or replacement of program equipment that is attributed to our child’s or guests reckless or irresponsible behaviour. CANCELLATION POLICY An administration fee of $50.00 per sailor is charged for all cancellations. For cancellation notices received prior to 30 days before the start date of the course refunds will be issued. Between 29 days and 7 days before the start of the course a refund will be issued only if that position is filled and paid by another student. For refunds due to a medical situation, later than 7 days prior to the start date of the course, a medical certificate will be required. No refunds will be made due to poor weather conditions. In accepting the foregoing release, I hereby acknowledge and represent that I have read the foregoing release, I understand it and agree to it voluntarily, that I am the full age of majority or, in the alternative, I have indicated that I am the guardian of the minor participant named, and agree that this agreement will be binding on my heirs, next of kin, executors, administrators, and successors. All fees must be paid upon registration to secure a reserved spot. Any unpaid accounts will be removed from the registration if the course is in waitlist status.
